The Terms govern your use of Bitcoin Depot’s website, mobile app, and physical kiosks in Brazil (the “Bitcoin Depot Offerings”). They incorporate the Privacy Notice, Refund Policy, Delivery Policy, FAQs, and any posted operating rules and price schedules. Services are provided by Bitcoin Depot Operating, LLC and Brazil BTM Limitada.

 

Os Termos regem seu uso do site, aplicativo móvel e Quiosques físicos da Bitcoin Depot no Brasil (as "Ofertas da Bitcoin Depot"). Eles incorporam o Aviso de Privacidade, Política de Reembolso, Política de Entrega, Perguntas Frequentes e quaisquer regras operacionais e tabelas de preços publicadas. Os serviços são fornecidos pela Bitcoin Depot Operating, LLC e pela Brazil BTM Limitada.

 

 

Eligibility and verification. To use the services, you must be at least 18 years old, capable of entering binding contracts, and a resident of Brazil. Some features require creating an account and completing identity verification (KYC). You must provide accurate Registration Data (such as name, date of birth, address, contact details, payment information, government ID data, and biometric data). You are responsible for keeping your credentials secure and must use the services only for yourself.

 

Elegibilidade e verificação. Para utilizar os serviços, você deve ter pelo menos 18 anos, ser capaz de firmar contratos vinculantes e residir no Brasil. Alguns recursos exigem a criação de uma conta e a verificação de identidade (KYC). Você deve fornecer Dados de Registro precisos (como nome, data de nascimento, endereço, dados de contato, informações de pagamento, dados de identificação do governo e dados biométricos). Você é responsável por manter suas credenciais seguras e deve usar os serviços apenas para você mesmo.

 

 

How transactions work. Bitcoin Depot sells you digital currency (for example, Bitcoin) in exchange for Brazilian reais (BRL) through kiosks and other channels. For kiosk purchases, you insert cash and Bitcoin Depot sends the purchased crypto to the wallet address you provide or issues a paper wallet/receipt. For cross‑border payments involving Brazil, transactions may be executed with the assistance of a Brazilian foreign‑exchange agent duly authorized to operate in the FX market; by accepting the Terms you authorize that FX agent to process the related exchange operations. You are responsible for the accuracy of the wallet address and all information you submit. Crypto sent to your designated address cannot be retrieved or refunded.

 

Como funcionam as transações. A Bitcoin Depot vende Moeda Digital (por exemplo, Bitcoin) em troca de reais brasileiros (BRL) por meio de Quiosques e outros canais. Para compras em Quiosques, você insere dinheiro e a Bitcoin Depot envia a cripto comprada para o endereço da carteira que você fornecer ou emite uma carteira/recibo em papel. Para pagamentos internacionais envolvendo o Brasil, as transações podem ser realizadas com o auxílio de um agente de câmbio brasileiro devidamente autorizado a operar no mercado de câmbio; ao aceitar os Termos, você autoriza esse agente a processar as operações de câmbio relacionadas. Você é responsável pela precisão do endereço da carteira e de todas as informações que enviar. As Criptos enviadas para o endereço que você designou não podem ser recuperadas nem reembolsadas.

 

 

Pricing, fees, and limits. An exchange service fee applies to all transactions and is disclosed before you confirm. Pricing includes a flat fee of BRL 15 and a spread of 17.3% to 50% over the transaction amount (calculated in BRL), which may be higher than other options. Bitcoin Depot may impose or change transaction limits. Unless otherwise stated, fee payments are final and non‑refundable.

Preços, taxas e limites. Uma taxa de serviço se aplica a todas as transações e é divulgada antes de você confirmar. A precificação inclui uma taxa fixa de R$15 e um spread de 17,3% a 50% sobre o valor da transação (calculado em reais), que pode ser maior do que outras opções. Cancellations and receipts. Digital asset prices are volatile and may affect final pricing. If a submitted order is canceled before completion, you may be responsible for market loss amounts. If a kiosk cash purchase is canceled before it completes, inserted BRL will be returned at the kiosk, subject to immediately contacting support and remaining present to receive funds. You will receive a receipt (paper, email, or SMS) indicating key terms and amounts.

 

 

Cancelamentos e recibos. Os preços dos ativos digitais são voláteis e podem afetar a precificação final. Se uma ordem submetida for cancelada antes da conclusão, você pode ser responsável pelos valores de prejuízo no mercado. Se a compra em dinheiro em um Quiosque for cancelada antes de ser concluída, os reais inseridos serão devolvidos no Quiosque, sujeito a contato imediato com o suporte e permanecendo presente para o recebimento dos recursos. Você receberá um recibo (em papel, e-mail ou SMS) indicando termos e quantias relevantes.

 

 

User conduct and restricted activities. You must comply with applicable laws, including AML and money transmission rules. Restricted activities include fraud, money laundering, terrorist financing, use of counterfeit currency, ransomware payments, illegal purchases, harassment, IP infringement, and any technical misuse of the website, app, or kiosks. Bitcoin Depot may suspend, limit, or terminate access and take other protective actions where risk or restricted activity is suspected.

 

Conduta do Usuário e atividades restritas. Você deve cumprir as leis aplicáveis, incluindo as regras de PLD e transmissão de valores. Atividades Restritas incluem fraude, lavagem de dinheiro, financiamento do terrorismo, uso de moeda falsa, pagamentos por ransomware, compras ilegais, assédio, infração de propriedade intelectual e qualquer uso técnico indevido do site, aplicativo ou Quiosques. A Bitcoin Depot pode suspender, limitar ou encerrar o acesso e tomar outras ações de proteção quando houver suspeita de risco ou atividade restrita.

 

 

Risks and no advice. Digital currencies fluctuate significantly and carry a high risk of loss. Holdings are not covered by deposit insurance programs. Bitcoin Depot does not provide financial, investment, legal, accounting, or tax advice. Consider your financial situation and seek professional guidance before buying or holding virtual assets.

 

Riscos e ausência de aconselhamento. As moedas digitais apresentam variações significativas e envolvem alto risco de perda. As posições mantidas não são cobertas por programas de seguro de depósitos. A Bitcoin Depot não presta consultoria financeira, de investimentos, jurídica, contábil ou tributária. Privacy and communications. The Privacy Notice applies and is incorporated into the Terms. For service and account updates, Bitcoin Depot may send informational SMS and emails (subject to consent and applicable law). Brazilian mobile carriers listed in the Terms are not liable for delayed or undelivered messages. You can opt out of SMS by replying STOP. Certain personal data, including ID and biometric data, may be used for identity verification and compliance purposes.

 

Privacidade e comunicações. O Aviso de Privacidade se aplica e está incorporado aos Termos. Para atualizações de serviços e contas, a Bitcoin Depot pode enviar SMS informativos e e-mails (sujeito ao consentimento e à legislação aplicável). Operadoras móveis brasileiras listadas nos Termos não são responsáveis por mensagens atrasadas ou não entregues. Você pode optar por não receber SMS respondendo STOP. Certos dados pessoais, incluindo identificação e dados biométricos, podem ser usados para fins de verificação de identidade e conformidade.

 

 

Intellectual property and content. Bitcoin Depot’s trademarks, logos, technology, and site/app content are protected. You may not use them without Bitcoin Depot’s prior written consent. If you post content through interactive services, you grant Bitcoin Depot a license to use it for service and marketing purposes, subject to content rules.

Governing law and disputes in Brazil. Brazilian law governs the Terms. Disputes must be brought in Brazilian State Courts, typically at the customer’s domicile, in line with the Consumer Defense Code. The Terms have been localized to comply with Brazilian consumer protections, including advance notice of changes, and highlight any clauses that may limit consumer rights, as required by law.

 

Lei aplicável e Disputas no Brasil. Os Termos são regidos pela legislação brasileira. Eventuais Disputas deverão ser submetidas ao Poder Judiciário Estadual, em regra no domicílio do consumidor, nos termos do Código de Defesa do Consumidor. Os Termos foram adaptados para cumprir as normas de proteção ao consumidor no Brasil, incluindo a exigência de aviso prévio sobre alterações, e destacam quaisquer cláusulas que possam limitar direitos do consumidor, conforme exigido pela lei.

 

 

Operational safeguards and force majeure. Bitcoin Depot may take protective actions (such as temporary holds or account limitations) to manage risk, fraud, or compliance concerns. Performance may be excused where force majeure events occur (for example, pandemics, cyber incidents, network failures, or natural disasters).

A Bitcoin Depot pode tomar medidas protetoras (como retenções temporárias ou limitações de contas) para gerenciar riscos, fraudes ou preocupações de conformidade. Expect both a flat fee and a spread, disclosed before you confirm each transaction. Be aware of transaction limits and possible market‑loss charges on cancellations. Each end-user visitor to the Site (“User,” “Customer,” “you” or “your”) agrees to the terms of the Agreement, in their entirety, when she/he: (a) accesses or uses a Bitcoin Depot Venue; (b) accesses and/or downloads any of the: (i) blog posts, text, audio, video, photographs, graphics, artwork and/or other content featured on/in the Bitcoin Depot Venues, including crypto currency-related content (collectively, “Informational Content”); and/or (ii) links to third party websites, products and/or services (“Third-Party Links,” and together with the Informational Content, the “Content”); (c) accesses links to Bitcoin Depot’s social media pages/accounts (collectively, “Social Media Pages”) on third-party social media websites, such as Facebook®, Instagram® and X (formerly known as Twitter®) (“Twitter”) (collectively; “Social Media Websites”); (d) accesses certain message boards, comments sections, customer ratings and other interactive features of the Site (collectively, “Interactive Services”); (e) registers to receive the Bitcoin Depot e-mail newsletter (“Newsletter”); (f) purchases Bitcoin (“Digital Currency”) by and through the Bitcoin Depot Venues" (“Purchase Services”); (g) uses the Kiosk-locater search functionality to locate a Kiosk near the User’s designated location (“Store Locator”); (h) accesses information regarding employment opportunities with Bitcoin Depot (“Career Opportunity Listings”); (i) uses the Bitcoin Depot mobile app (“Mobile App”); and/or (j) utilizes the various contact forms and/or contact information made available via the Bitcoin Depot Venues as a means to contact directly, or request to be contacted by, Bitcoin Depot (collectively, the “Contact Services”).

 

Cada usuário-final visitante do Site ("Usuário", "Cliente", "você" ou "seu") concorda com os termos do Contrato, em sua totalidade, quando ele(a): (a) acessa ou utiliza um Locais da Bitcoin Depot; (b) acessa e/ou baixa qualquer dos: (i) posts de blog, texto, áudio, vídeo, fotografias, gráficos, obras de arte e/ou outro conteúdo apresentado em/nos Locais da Bitcoin Depot, incluindo conteúdo relacionado a criptomoedas (coletivamente, "Conteúdo Informativo"); e/ou (ii) links para sites, produtos e/ou serviços de terceiros ("Links de Terceiros" e, juntamente com o Conteúdo Informativo, o "Conteúdo"); (c) acessa links para as páginas/contas de redes sociais da Bitcoin Depot (coletivamente, "Páginas de Mídia Social") em sites de redes sociais de terceiros, como Facebook®, Instagram® e X (anteriormente conhecido como Twitter®) ("Twitter") (coletivamente; "Sites de Redes Sociais"); (d) acessa certos fóruns de mensagens, seções de comentários, avaliações de clientes e outros recursos interativos do Site (coletivamente, "Serviços Interativos"); (e) se registra para receber o boletim informativo por e-mail da Bitcoin Depot ("Newsletter"); (f) compra Bitcoin ("Moeda Digital") por e por meio dos Locais da Bitcoin Depot" ("Serviços de Compra"); (g) utiliza a funcionalidade de busca de Quiosques para localizar um Quiosque próximo à localização designada pelo Usuário ("Localizador de Quiosque"); (h) acessa informações sobre oportunidades de emprego com a Bitcoin Depot ("Listas de Oportunidades de Carreira"); (i) utiliza o aplicativo móvel Bitcoin Depot ("App Móvel"); e/ou (j) utiliza os diversos formulários de contato e/ou informações de contato disponibilizados pelos Locais da Bitcoin Depot como meio de entrar em contato diretamente, ou solicitar ser contatado, pela Bitcoin Depot (coletivamente, os "Serviços de Contato").

1. Scope; Modification of Agreement. The Agreement constitutes the entire and only agreement between Users and Bitcoin Depot with respect to Users’ use of the Bitcoin Depot Offerings, and supersedes all prior or contemporaneous agreements, representations, warranties and/or understandings with respect to same. We may amend the Agreement from time to time, and you will receive a prior notice of these changes and an opportunity to decide whether you consent to them.  In addition, (a) any prohibition on class action provisions or any other provisions applicable to dispute resolution (collectively, “Dispute Resolution Provisions”), whenever applicable, shall not apply to any disputes incurred prior to the applicable amendment or modification; and (b) any amendment or modification to pricing and/or billing provisions (“Billing Provisions”) shall not apply to any charges incurred prior to the applicable amendment or modification. The latest Agreement will be posted on the Site and in the User interface associated with the Kiosks, and you should review the Agreement prior to using the Bitcoin Depot Offerings. By your continued use of the Bitcoin Depot Offerings, you hereby agree to comply with, and be bound by, all of the terms and conditions contained within the Agreement effective at that time (other than with respect to disputes arising prior to the amendment or modification of the Dispute Resolution Provisions, or charges incurred prior to the amendment or modification of the Billing Provisions, which shall be governed by the Dispute Resolution Provisions and/or Billing Provisions then in effect at the time of the subject dispute or incurred charges, as applicable).

1. Escopo; Modificação do Contrato. O Contrato constitui o acordo completo e único entre os Usuários e a Bitcoin Depot com relação ao uso das Ofertas da Bitcoin Depot pelos Usuários, e prevalece sobre todos os acordos, declarações, garantias e/ou entendimentos anteriores ou contemporâneos a respeito. Podemos alterar o Contrato de tempos em tempos, e você receberá um aviso prévio dessas mudanças e a oportunidade de decidir se consente com elas.  Além disso, (a) qualquer proibição de cláusulas de ações coletivas ou quaisquer outras disposições aplicáveis à resolução de Disputas (coletivamente, "Disposições de Resolução de Disputas"), sempre que aplicável, não se aplicará a quaisquer Disputas ocorridas antes da emenda ou modificação aplicável; e (b) qualquer alteração ou modificação às disposições de preços e/ou faturamento ("Disposições de Faturamento") não se aplicará a quaisquer encargos incorridos antes da emenda ou modificação aplicável. O Contrato mais recente será publicado no Site e na interface do Usuário associada aos Quiosques, e você deve revisar o Contrato antes de usar as Ofertas da Bitcoin Depot. Ao continuar utilizando as Ofertas da Bitcoin Depot, você concorda em cumprir e se submeter a todos os termos e condições contidos no Contrato vigentes naquele momento (exceto em relação a Disputas surgidas antes da alteração ou modificação das Disposições de Resolução de Disputas, ou cobranças incorridas antes da alteração ou modificação das Disposições de Faturamento,  que serão regidas pelas Disposições de Resolução de Disputas e/ou Disposições de Faturamento vigentes no momento da Disputa ou das cobranças incorridas, conforme aplicável).

2.1. Bitcoin Depot is a Registered Money Services Business. As a registered Money Service Business, Bitcoin Depot sells and purchases Digital Currency from third parties and then resells that Digital Currency to you in exchange for Fiat Sovereign backed currency, such as the Brazilian Real (“BRL”). If you violate any portion of the Agreement, we have the right to refuse your transaction and prohibit you from using the Bitcoin Depot Offerings indefinitely without reason or explanation.

2.1. Bitcoin Depot é uma Empresa Registrada de Serviços Financeiros. Como uma Empresa Registrada de Serviços Financeiros, a Bitcoin Depot vende e compra Moeda Digital de terceiros e depois revende essa Moeda Digital para você em troca de moeda fiduciária soberana, como os Reais brasileiros. Se você violar qualquer parte do Contrato, temos o direito de recusar sua transação e proibir seu uso das Ofertas da Bitcoin Depot indefinidamente e sem motivo ou explicação.

If you receive Information about another User through the Bitcoin Depot Offerings, you must keep the Information confidential and only use it in connection with the Bitcoin Depot Offerings. You may not disclose or distribute a User's Information to a third party or use the Information for marketing purposes.

"bitcoindepot.com," "Bitcoin Depot," and all logos related to the Bitcoin Depot Offerings are either common law trademarks or registered trademarks of Bitcoin Depot or its licensors. You may not copy, imitate or use them without Bitcoin Depot’s prior written consent. In addition, all page headers, custom graphics, button icons and scripts are service marks, trademarks and/or trade dress of Bitcoin Depot. You may not copy, imitate or use them without our prior written consent. All right, title and interest in and to the Bitcoin Depot Venues, any Content made available in connection therewith, the other Bitcoin Depot Offerings, the technology related to the Bitcoin Depot Offerings, and any and all technology and any content created or derived from any of the foregoing is the exclusive property of Bitcoin Depot and its licensors.

 

2.4. Propriedade Intelectual. 2.5. Assignment. You may not transfer or assign any rights or obligations you have under the Agreement without Bitcoin Depot’s prior written consent in each instance. Bitcoin Depot reserves the right to transfer or assign the Agreement or any right or obligation under the Agreement at any time.

2.5. Cessão. Você não pode transferir ou ceder quaisquer direitos ou obrigações que tenha sob o Contrato sem o consentimento prévio por escrito da Bitcoin Depot em cada caso. 2.6 Notices to You. You agree that Bitcoin Depot may provide notice to you by posting it on our Site and in the User interface associated with the Kiosk, emailing it to the email address listed in your Account, sending an SMS text message to the phone number listed in your Account (where we have obtained your consent to do so, and subject to any restrictions imposed by applicable law) or mailing it to the street address associated with your Account. Such notice shall be considered received by you within twenty-four (24) hours of the time it is posted on our Site and in the User interface associated with the Kiosk or, as applicable, the time it is emailed to you unless we receive notice that the email was not delivered. If the notice is sent by mail, such notice shall be considered received three (3) Business Days after it is sent. You may request a paper copy of any legally required disclosures and you may terminate your consent to receive required disclosures through electronic communications by contacting Bitcoin Depot as described in section 2.7 below.

 

2.6 Avisos para você. Você concorda que a Bitcoin Depot pode fornecer notificação a você publicando em nosso site e na interface de Usuário associada ao Quiosque, enviando por e-mail para o endereço de e-mail listado em sua Conta, enviando uma mensagem SMS para o número de telefone listado em sua Conta (onde obtivemos seu consentimento para isso, e sujeito a quaisquer restrições impostas pela lei aplicável) ou enviando o endereço para o endereço associado à sua Conta. You may text “HELP,” or email us at Support@BitcoinDepot.com, for help. We shall not be liable for delayed or undelivered messages.

3. Accounts.

3.1 Opening an Account. In order to use some of the Bitcoin Depot Offerings, you must create an account with Bitcoin Depot (“Account”), and/or you must provide information sufficient for us to verify your identity each time you use the Bitcoin Depot Offerings. The information that you must supply in order to open an Account and/or use certain of the Bitcoin Depot Offerings may include, without limitation: (a) your full name; (b) your date of birth; (c) your mailing/billing address; (d) your e-mail address; (e) your telephone number; (f) your credit card information, debit card information and/or bank account information (where purchasing Digital Currencies); (g) certain biometric information used to confirm your identity; (h) certain identification-related data (such as your Social Security Number, driver’s license number and related information, and passport number and related information); and/or (i) any other information requested by us via the applicable Bitcoin Depot Venue (collectively, “Registration Data”). You agree to: (i) provide accurate, truthful and current Registration Data when creating an Account or when using one of our Kiosks; (b) use your Account and the Bitcoin Depot Offerings only for yourself, not share access to your Account with others and not conduct transactions on behalf of others by and through your Account; and (iii) promptly notify us if you discover or otherwise suspect any security breaches or misuse related to your Account. You are responsible for maintaining the confidentiality of your Account and associated log-in information, and for restricting access to your computer, and you agree to accept responsibility for all activities that occur through use of your Account, including any purchases or other transactions made therethrough. Further, you expressly represent and warrant that you will only send funds to your own personal wallet and not the wallet of any third party individual or entity. Bitcoin Depot has no obligation to sell Bitcoin or provide any other services offered as part of the Bitcoin Depot Offerings if all applicable Registration Data is not complete fully and accurately.

 

3.1 Abrindo uma Conta. Para utilizar algumas das Ofertas da Bitcoin Depot, você deve criar uma conta na Bitcoin Depot ("Conta") e/ou fornecer informações suficientes para que possamos verificar sua identidade toda vez que usar as Ofertas da Bitcoin Depot. As informações que você deve fornecer para abrir uma Conta e/ou usar certas das Ofertas da Bitcoin Depot podem incluir, sem limitação: (a) seu nome completo; (b) sua data de nascimento; (c) seu endereço de correspondência/faturamento; (d) seu endereço de e-mail; (e) seu número de telefone; (f) suas informações de cartão de crédito, informações do cartão de débito e/ou informações da conta bancária (quando estiver adquirindo Moedas Digitais); (g) certas informações biométricas usadas para confirmar sua identidade; (h) certos dados relacionados à identificação (como seu número de CPF, número CNH e informações relacionadas, e número do passaporte e informações relacionadas); e/ou (i) qualquer outra informação solicitada por nós através do Local da Bitcoin Depot aplicável (coletivamente, "Dados de Registro"). Você concorda em: (i) fornecer Dados de Registro precisos, verdadeiros e atualizados ao criar uma Conta ou ao usar um de nossos Quiosques; (b) usar sua Conta e as Ofertas da Bitcoin Depot apenas para você, não compartilhar acesso à sua Conta com terceiros e não realizar transações em nome de terceiros por meio da sua Conta; e (iii) nos notificar prontamente se você descobrir ou suspeitar de qualquer violação de segurança ou uso indevido relacionado à sua Conta. Você é responsável por manter a confidencialidade da sua Conta e das informações de login associadas, além de restringir o acesso ao seu computador, e concorda em aceitar a responsabilidade por todas as atividades que ocorram por meio do uso da sua Conta, incluindo quaisquer compras ou outras transações feitas por meio dela. Além disso, você expressamente declara e garante que enviará fundos apenas para sua própria carteira pessoal e não para a carteira de terceiros. A Bitcoin Depot não tem obrigação de vender Bitcoin ou fornecer quaisquer outros serviços oferecidos como parte das Ofertas da Bitcoin Depot caso todos os Dados de Registro relevantes não estejam totalmente completos e precisos.

 

 

3.2. Eligibility. To be eligible to access the Bitcoin Depot Offerings, you must be: (a) at least eighteen (18) years of age (or the age of majority if greater than eighteen (18) years of age in your jurisdiction of residence) or older; and (b) able to enter into legally binding contracts under applicable law; and (c) a resident of the Federative Republic of Brazil (“Brazil”) (collectively, “Usage Requirements”). The Bitcoin Depot Offerings are not intended for individuals who do not satisfy the Usage Requirements. By using the Bitcoin Depot Offerings, you represent and warrant that you: (i) are of legal age to form a binding contract in your jurisdiction; (ii) have not previously been suspended from using the Bitcoin Depot Offerings; (iii) are a resident of     Brazil; (iv) have full power and authority to enter into the Agreement and in doing so will not violate any other agreement to which you are a party; and (v) are not under the control of, or a national or resident of any country to which Brazil has embargoed goods or services. If you are using the Bitcoin Depot Offerings on behalf of a legal entity, you further represent and warrant that: (A) such legal entity is duly organized and validly existing under the laws applicable to its jurisdiction of organization; and (B) you are duly authorized by such legal entity to act on its behalf.

3.2. Elegibilidade. Para ser elegível para acessar as Ofertas da Bitcoin Depot, você deve ter: (a) pelo menos dezoito (18) anos de idade (ou a maioridade se esta for atingida após dezoito (18) anos de idade na sua jurisdição de residência) ou mais; e (b) poder celebrar contratos legalmente vinculativos sob a lei aplicável; e (c) ser um residente da República Federativa do Brasil ("Brasil") (coletivamente, "Requisitos de Uso"). As Ofertas da Bitcoin Depot não são destinadas a indivíduos que não atendem aos Requisitos de Uso. Ao utilizar as Ofertas da Bitcoin Depot, você declara e garante que: (i) tem idade legal para formar um contrato vinculativo em sua jurisdição; (ii) não foi anteriormente suspensos do uso das Ofertas da Bitcoin Depot; (iii) é residente no Brasil; (iv) tem pleno poder e autoridade para celebrar o Contrato e, ao fazê-lo, não violará nenhum outro acordo do qual você seja parte; (v) não está sob o controle, nem é nacional ou residente de qualquer país ao qual o Brasil tenha embargado bens ou serviços. Se você estiver utilizando as Ofertas da Bitcoin Depot em nome de uma entidade jurídica, você ainda declara e garante que: (A) tal entidade legal está devidamente organizada e existe validamente sob as leis aplicáveis à sua jurisdição de organização; e (B) você está devidamente autorizado por tal entidade legal a agir em seu nome.

 

 

3.3. Identity Authentication. You authorize Bitcoin Depot, directly or through third party identification verification service providers, to make any inquiries we consider necessary to validate your identity. This may include: (a) asking you for further information; (b) requiring you to provide a taxpayer identification number; (c) requiring you to take steps to confirm ownership of your email address and/or financial instruments; and/or (d) verifying your Information against third party databases or through other sources. Prior to your use of the Bitcoin Depot Offerings by and through a Kiosk, you must provide all of the information requested by Bitcoin Depot via the applicable Bitcoin Depot Venue including, without limitation, Registration Data and any additional information requested (collectively, “Personal Information”). You acknowledge that Bitcoin Depot will analyze and validate your identity by reference to the Personal Information that you provided to determine whether you qualify to use the Bitcoin Depot Offerings (“Verification Process”). Your use of the Bitcoin Depot Offerings may be delayed during the Verification Process, and Bitcoin Depot disclaims responsibility for any loss, delay or other harm relating thereto. If you do not pass the Verification Process, or if you fail to provide any of the information required to access the Bitcoin Depot Offerings, you will be denied access to the Bitcoin Depot Offerings. If you believe your access to the Bitcoin Depot Offerings has been wrongly denied, please contact us at: support@bitcoindepot.com.

 

3.3. Autenticação de Identidade. Você autoriza a Bitcoin Depot, diretamente ou por meio de provedores terceirizados de serviços de verificação de identificação, a fazer quaisquer consultas que consideremos necessárias para validar sua identidade. Isso pode incluir: (a) solicitar mais informações; (b) exigir que você forneça um número de identificação de contribuinte; (c) exigir que você tome medidas para confirmar a propriedade do seu endereço de e-mail e/ou instrumentos financeiros; e/ou (d) verificar suas informações contra bancos de dados de terceiros ou por meio de outras fontes. Antes de utilizar as Ofertas da Bitcoin Depot por meio de um Quiosque, você deve fornecer todas as informações solicitadas pela Bitcoin Depot através do Local da Bitcoin Depot aplicável, incluindo, sem limitação, Dados de Registro e quaisquer informações adicionais solicitadas (coletivamente, "Informações Pessoais"). Você reconhece que a Bitcoin Depot analisará e validará sua identidade com base nas Informações Pessoais que você forneceu para determinar se você se qualifica para usar as Ofertas da Bitcoin Depot ("Processo de Verificação"). Seu uso das Ofertas da Bitcoin Depot pode ser atrasado durante o Processo de Verificação, e a Bitcoin Depot renuncia à responsabilidade por qualquer perda, atraso ou outro dano relacionado a isso. Se você não passar no Processo de Verificação, ou se não fornecer nenhuma das informações necessárias para acessar as Ofertas da Bitcoin Depot, será negado o acesso às Ofertas da Bitcoin Depot. 3.4. Third Party Permissions. If you grant express permission to a third party to take specific actions on your behalf, or access particular information about your Account, either through your use of the third party’s product or service or otherwise, you acknowledge that Bitcoin Depot may disclose the information about your Account that is specifically authorized by you to be provided to this third party. You also acknowledge that granting permission to a third party to take specific actions on your behalf does not relieve you of any of your responsibilities under the Agreement. Further you acknowledge and agree that you will not hold Bitcoin Depot responsible for, and will indemnify Bitcoin Depot from and against, any and all liability arising from the actions or inactions in connection with the permissions you grant.

3.4. Permissão de Terceiros. Se você conceder permissão expressa a um terceiro para tomar ações específicas em seu nome, ou acessar informações específicas sobre sua Conta, seja por meio do uso do produto ou serviço do terceiro ou de outra forma, você reconhece que a Bitcoin Depot pode divulgar as informações sobre sua Conta que estejam especificamente autorizadas por você a serem fornecidas a este terceiro. Você também reconhece que conceder permissão a um terceiro para tomar ações específicas em seu nome não o isenta de nenhuma de suas responsabilidades sob o Contrato. Além disso, você reconhece e concorda que não responsabilizará a Bitcoin Depot por, e irá isentar a Bitcoin Depot de qualquer responsabilidade decorrente das ações ou omissões relacionadas às permissões que conceder.

 

 

3.5. Necessary Equipment. You are responsible, at all times, for ensuring that you have an Internet connection, computer/mobile device, up-to-date Internet browser versions, a functioning e-mail account, applicable software, applicable hardware and/or other equipment necessary to access the Bitcoin Depot Offerings. Bitcoin Depot does not guarantee the quality, speed or availability of the Internet connection associated with your mobile device and/or computer. Bitcoin Depot does not guarantee that the Bitcoin Depot Offerings can be accessed: (a) on all mobile devices; (b) through all wireless service plans; (c) in connection with all Internet browsers; or (d) in all geographical areas. Standard messaging, data and wireless access fees may apply to your use of the Bitcoin Depot Offerings through your wireless device. You are fully responsible for all such charges and Bitcoin Depot has no liability or responsibility to you, whatsoever, for any such charges billed by your wireless carrier.

 

3.5. Equipamentos necessários. Você é responsável, em todo momento, por garantir que tenha conexão com a Internet, computador/dispositivo móvel, versões atualizadas do navegador de Internet, uma conta de e-mail funcional, software aplicável, hardware e/ou outros equipamentos necessários para acessar as Ofertas da Bitcoin Depot. A Bitcoin Depot não garante a qualidade, velocidade ou disponibilidade da conexão com a Internet associada ao seu dispositivo móvel e/ou computador. A Bitcoin Depot não garante que as Ofertas da Bitcoin Depot possam ser acessadas: (a) em todos os dispositivos móveis; (b) por todos os planos de serviço sem fio; (c) em conexão com todos os navegadores de Internet; ou (d) em todas as áreas geográficas. Taxas padrão de mensagens, dados e acesso sem fio podem ser aplicadas ao seu uso das Ofertas da Bitcoin Depot através do seu dispositivo sem fio. Você é totalmente responsável por todas essas cobranças e a Bitcoin Depot não tem nenhuma responsabilidade ou responsabilidade com você por quaisquer cobranças cobradas pela sua operadora sem fio.

 

 

4. Transactions: Kiosk and Physical Agent Transactions.

The terms of this Section 4 apply to any purchase of Digital Currency carried out via a Kiosk or physical agent location (each, an “Order”).

4.1. Order Information. You must provide all information requested by Bitcoin Depot in connection with any Order, including, without limitation, the amount of BRL you intend to spend in connection with the purchase and the Digital Currency wallet address to which Bitcoin Depot will send the Digital Currency you purchase. You are solely responsible for the accuracy of any Order information you submit. ​

4.1.1. For you to use the Kiosk, any payment that involves a cross-border transaction to/from Brazil shall be provided jointly with a Brazilian financial institution duly authorized to operate in the FX market and engaged by Bitcoin Depot to act as the FX agent who will enter into the FX transactions in order to allow your cross-border remittances. By entering on our app, accepting these terms and conditions, and, consequently, accepting to execute the process through a FX agent, you agree to grant all the necessary powers to the FX agent to receive these funds and execute the necessary exchange transaction for the use of our Services.

 

 

4.1.1. Para que você possa utilizar o Quiosque, qualquer pagamento que envolva uma transação internacional de/para o Brasil deverá ser realizado em conjunto com uma instituição financeira brasileira devidamente autorizada a operar no mercado de câmbio e contratada pela Bitcoin Depot para atuar como agente de câmbio, a qual celebrará as operações de câmbio necessárias para viabilizar as suas remessas internacionais. Ao acessar nosso aplicativo, aceitar estes termos e condições e, consequentemente, concordar com a execução do processo por meio de um agente de câmbio, você concorda em outorgar ao agente de câmbio todos os poderes necessários para receber tais recursos e realizar as operações de câmbio necessárias para a utilização de nossos Serviços.

 

 

4.2. Offer Terms. When you place an Order, you will be able to view the specific terms and conditions applicable to your Order which may include, without limitation, a price at which Bitcoin Depot will sell Digital Currency to you and all applicable fees. ​

4.3. Order Completion. In order to accept Bitcoin Depot’s offer to purchase Digital Currency, you must satisfy any terms and conditions stated in the Offer Terms including, without limitation, by fulfilling the requirements outlined below.

(a) Purchase Order Completion. To complete your purchase of Digital Currency from Bitcoin Depot via a Kiosk, in accordance with the applicable Offer Terms, you must insert cash into the Kiosk to pay Bitcoin Depot in accordance with the applicable pricing and other terms, whereupon Bitcoin Depot will send the amount of Digital Currency calculated by the exchange rate specified in the Offer Terms and other markup to the Digital Currency wallet address you provide within a reasonable timeframe; provided, however, that we cannot guarantee that the Digital Currency will be transmitted to your address within any specific timeframe or that the wallet address you provide will be compatible with the specific cryptocurrency you select.

4.4. Receipts. Upon completion of a purchase transaction with Bitcoin Depot, you will either be provided with a paper wallet containing your Digital Currency, or the Digital Currency will be transferred to your designated Digital Currency address, and you may receive a paper receipt from the Kiosk, an email, or an SMS text message that contains the Offer Terms and/or actual amount of Digital Currency purchased from Bitcoin Depot.

4.4. Recibos. 4.5. Transactions. Transactions may, as applicable and permitted by Bitcoin Depot, be placed online twenty-four (24) hours a Day, seven (7) Days a week or via physical Kiosk or physically at an authorized agent/dealer during available specified hours. Upon confirmation, an e-mail or SMS text message may be sent to the Customer. Bitcoin Depot encourages all Customers to log into their Digital Currency wallet account within one (1) hour of initiating a purchase transaction in order to verify the transaction's status and to review all payment procedures and the transaction history.

4.5. Transações. As transações podem, conforme aplicável e permitido pela Bitcoin Depot, ser feitas online vinte e quatro (24) horas por dia, sete (7) dias por semana, ou por Quiosque físico ou fisicamente em um agente/revendedor autorizado durante os horários especificados disponíveis. Após confirmação, um e-mail ou SMS pode ser enviado ao Cliente. A Bitcoin Depot incentiva todos os clientes a acessarem sua conta de carteira de Moeda Digital em até uma (1) hora após iniciar uma transação de compra para verificar o status da transação e revisar todos os procedimentos de pagamento e o histórico de transações.

 

 

4.6. ​PURCHASE RESTRICTIONS. WE MAY, AT OUR DISCRETION, IMPOSE LIMITS ON THE AMOUNT OF DIGITAL CURRENCY YOU CAN BUY OR SEND THROUGH THE BITCOIN DEPOT OFFERINGS. BITCOIN DEPOT RESERVES THE RIGHT TO UNILATERALLY AMEND EXISTING RESTRICTIONS OR IMPLEMENT NEW RESTRICTIONS WITHOUT NOTICE AT ANY TIME.

4.6. RESTRIÇÕES DE COMPRA. PODEMOS, A NOSSO CRITÉRIO, IMPOR LIMITES À QUANTIDADE DE MOEDA DIGITAL QUE VOCÊ PODE COMPRAR OU ENVIAR ATRAVÉS DAS OFERTAS DA BITCOIN DEPOT. 4.7. Price Confirmations for Customer Purchase Transactions. An estimated price is displayed at the time a Customer Purchase Transaction is submitted. However, the price at the time a transaction is submitted may be subject to market fluctuations. Bitcoin Depot, in its sole discretion, may choose to require that a Customer have a portion of the intended purchase price, or the entire intended purchase price, in cleared funds, prior to placing an Order. Should a Customer wish to cancel an Order at any point prior to when a transaction has been completed, the Customer may be liable for cancellation fees as described in the Agreement and/or otherwise via the applicable Bitcoin Depot Venue. Customer acknowledges and agrees that Bitcoin Depot is not liable for any services or goods which are provided by or facilitated by any third party. Moreover, Customer acknowledges that Bitcoin Depot cannot retrieve or return any funds (including, but not limited to, cryptocurrencies) once sent to the designated address and, therefore, Bitcoin Depot does not provide any refunds after such point.

YOU SHOULD THEREFORE CONSIDER WHETHER TRADING OR HOLDING DIGITAL CURRENCY IS SUITABLE FOR YOU CONSIDERING YOUR FINANCIAL CIRCUMSTANCES. IT IS IMPORTANT THAT YOU FULLY UNDERSTAND THE RISKS INVOLVED BEFORE MAKING A DECISION TO USE THE SERVICES.

4.8. OS PREÇOS DA MOEDA DIGITAL PODEM OSCILAR SIGNIFICATIVAMENTE E EXISTE UM RISCO MATERIAL DE PERDA ECONÔMICA AO COMPRAR, VENDER OU INVESTIR EM MOEDA DIGITAL. 5.1. ​Acceptable Methods of Payment – Customer Purchase Transactions. Bitcoin Depot accepts for cash whenever a Customer Purchase Transactions is made by means of a Kiosk. Bitcoin Depot reserves the right to choose to accept or refuse any method of payment, at any time, in its sole discretion.

5.1. Métodos Aceitos de Pagamento – Transações de Compra do Cliente. A Bitcoin Depot aceita em dinheiro sempre que uma transação de compra de cliente é feita por meio de um Quiosque. 5.2. ​Payments from Business Accounts. Any payment from a Customer Purchase Transaction from a Business Account, where permitted by Bitcoin Depot, can be made in the business’s name only. For sole proprietorships, payment can be made in the business’s name or the sole proprietor’s name, provided proper authorization documentation has been received.

5.2. Pagamentos de Contas Empresariais. Qualquer pagamento de uma Transação de Compra de Cliente a partir de uma Conta Empresarial, quando permitido pela Bitcoin Depot, pode ser feito apenas em nome da empresa. Para empresários individuais, o pagamento pode ser feito em nome da empresa ou do empresário individual, desde que a documentação de autorização adequada tenha sido recebida.

 

 

6. ​ Transaction Cancellations.

6.1. ​WHEN CANCELLING A TRANSACTION, MARKET LOSS REPAYMENTS MAY APPLY GIVEN THAT A SUBMITTED TRANSACTION CONSTITUTES A BINDING AGREEMENT BETWEEN BITCOIN DEPOT AND THE CUSTOMER.

6.2. Customer Purchase Transactions. In the event that a Customer Purchase Transaction is cancelled (whether by the Customer or by Bitcoin Depot for failure to receive payment in full within the time stipulated in the Offer Terms), market loss payments may be due from Customer to Bitcoin Depot. Under no circumstances will Bitcoin Depot be liable to pay Customer for changes in the underlying market price.

6.2. Transações de Compra do Cliente. No caso de uma Transação de Compra do Cliente ser cancelada (seja pelo Cliente ou pela Bitcoin Depot por não receber o pagamento integral dentro do prazo estipulado nos Termos da Oferta), pagamentos de perdas de mercado podem ser devidos do Cliente para a Bitcoin Depot. Em nenhuma circunstância a Bitcoin Depot será responsável por pagar ao Cliente por mudanças no preço de mercado subjacente.

 

 

7. Account Balances.

7.1. ​Online Balances. Bitcoin Depot does not currently provide the ability to hold funds online. Should we choose to do so in the future, if you hold a Bitcoin balance online with Bitcoin Depot, Bitcoin Depot will hold your funds separate from its corporate funds, will not use your funds for its operating expenses or any other corporate purposes, and will not voluntarily make your funds available to its creditors in the event of bankruptcy. Bitcoin Depot further reserves the right to use a third party for holding funds and you may be subject to the terms of use of such third party.

7.1. Saldos Online. A Bitcoin Depot atualmente não oferece a capacidade de manter fundos online. Caso optemos por fazer isso no futuro, se você detiver um saldo de Bitcoin online com a Bitcoin Depot, a Bitcoin Depot manterá seus fundos separados dos fundos corporativos, não usará seus fundos para despesas operacionais ou outros fins corporativos, e não disponibilizará voluntariamente seus fundos aos credores em caso de falência. A Bitcoin Depot ainda reserva o direito de usar um terceiro para manter fundos e você pode estar sujeito aos termos de uso desse terceiro.

 

 

8. Closing Your Account.

8.1. ​How to Close Your Account. You may request to close your Account at any time by contacting Customer Service, which can be accessed online through the Bitcoin Depot customer portal (if available), or by emailing us at: support@bitcoindepot.com. Bitcoin Depot reserves the right to retain any and all data relating to or arising from Accounts.

Você pode solicitar o encerramento da sua conta a qualquer momento entrando em contato com o Atendimento ao Cliente, que pode ser acessado online pelo portal do cliente Bitcoin Depot (se disponível), ou enviando um e-mail para nós: support@bitcoindepot.com. A Bitcoin Depot reserva o direito de reter todos os dados relacionados ou decorrentes de Contas.

 

 

8.2. ​Limitations on Closing Your Account. You may not close your Account to evade an investigation. If you attempt to close your Account while we are investigating, we may freeze your transaction(s) to protect Bitcoin Depot and/or any third party against the risk of reversals, Chargebacks, Claims, fees, fines, penalties and other liability. You will remain liable for all obligations related to your Account even after the Account is closed.

 

8.2. Limitações para Fechar Sua Conta. Você não pode fechar sua conta para evitar uma investigação. Se você tentar fechar sua Conta enquanto estamos investigando, podemos congelar sua(s) transação(ões) para proteger a Bitcoin Depot e/ou qualquer terceiro contra o risco de reversões, Estornos, Reivindicações, taxas, multas, penalidades e outras responsabilidades. Você continuará sendo responsável por todas as obrigações relacionadas à sua Conta mesmo após o encerramento da Conta.

 

 

9. Fees. The following section outlines all fees that Bitcoin Depot may charge you in relation to Digital Currency exchange, payment, and transactions. Unless otherwise specified, all fees stated are in Brazilian Reais.

9. Taxas. A seção a seguir descreve todas as taxas que a Bitcoin Depot pode cobrar em relação à troca, pagamento e transações de Moeda Digital. Salvo indicação em contrário, todas as taxas declaradas estão em Reais brasileiros.

 

 

9.1. ​Exchange Service Fee. A service fee shall be applied to all exchange transactions and such fee will be communicated to the Customer prior to confirmation of the transaction. The transaction value and service fees are calculated/quoted in “BRL”. The service fee will be a flat fee of 15 BRL and Bitcoin Depot shall charge a spread between seventeen and three tenths’ percent (17.3%) and fifty percent (50%) of the total transaction amount calculated in BRL depending upon location. The spread refers to the difference between the cash inserted into the kiosk and the current market value of Bitcoin received, excluding the 15 BRL flat fee, which may be significantly greater than other available options for converting fiat currency to Digital Currency.

9.1. Taxa de Serviço de Troca. Uma taxa de serviço será aplicada a todas as transações de câmbio e tal taxa será comunicada ao Cliente antes da confirmação da transação. O valor da transação e as taxas de serviço são calculados/cotados em "BRL". A taxa de serviço será fixa de 15 BRL e a Bitcoin Depot cobrará um spread entre dezessete e três décimos por cento (17,3%) e cinquenta por cento (50%) do valor total da transação calculado em BRL, dependendo da localização. O spread refere-se à diferença entre o dinheiro inserido no Quiosque e o valor de mercado atual da Bitcoin recebido, excluindo a taxa fixa de 15 BRL, que pode ser significativamente maior do que outras opções disponíveis para converter moeda fiduciária em Moeda Digital.

 

 

9.2 General Payment Terms. Where you pay any fees using a credit card or debit card (collectively, “Payment Card”), you must promptly notify us if your Payment Card is cancelled or is no longer valid (e.g., due to loss or theft). UNLESS OTHERWISE INDICATED, ALL FEE PAYMENTS ARE FINAL AND NON-REFUNDABLE. Subject to the conditions set forth herein, you agree to be bound by the Billing Provisions of Bitcoin Depot in effect at any given time. Upon prior notice to you (with Site-updates, Kiosk-updates and/or e-mail sufficing), Bitcoin Depot reserves the right to change its Billing Provisions whenever necessary, in its sole discretion. Continued use of the Bitcoin Depot Offerings after receipt of such notice shall constitute consent to all such changes; provided, however, that any amendment or modification to the Billing Provisions shall not apply to any charges incurred prior to the applicable amendment or modification.

 

 

 

9.2 Termos Gerais de Pagamento. Quando você paga qualquer taxa usando cartão de crédito ou débito (coletivamente, "Cartão de Pagamento"), você deve nos notificar prontamente se seu Cartão de Pagamento for cancelado ou não for mais válido (por exemplo, devido a perda ou roubo). Sujeito às condições aqui estabelecidas, você concorda em se submeter às Disposições de Faturamento da Bitcoin Depot em vigor a qualquer momento. Mediante aviso prévio a você (com atualizações do Site, atualizações de Quiosques e/ou e-mail suficientes), a Bitcoin Depot reserva o direito de alterar suas Disposições de Faturamento sempre que necessário, a seu exclusivo critério. O uso contínuo das Ofertas da Bitcoin Depot após o recebimento desse aviso constitui consentimento para todas essas mudanças; desde que, no entanto, qualquer alteração ou modificação às Disposições de Faturamento não se aplique a quaisquer encargos incorridos antes da alteração ou modificação aplicável.

 

 

9.3 Electronic Signatures: Bitcoin Depot’s authorization to provide and bill for the applicable Bitcoin Depot Offerings is obtained by way of your electronic signature or, where applicable, via physical signature and/or voice affirmation. Once an electronic signature is submitted, this electronic order constitutes an electronic letter of agency. Bitcoin Depot’s reliance upon your electronic signature was specifically sanctioned and written into law when the Uniform Electronic Transactions Act and the Electronic Signatures in Global and National Transactions Act were enacted in 1999 and 2000, respectively and by Provisional Measure No. 2,200-2, of August 24, 2001 (collectively, the “E-Sign Act”). Both laws (Uniform Electronic Transactions Act and the Electronic Signatures in Global and National Transactions Act) specifically preempt all state laws that recognize only paper and handwritten signatures. Pursuant to all applicable statutes, regulations, rules, ordinances or other laws including, without limitation, the E-Sign Act and other similar state and federal statutes, YOU HEREBY AGREE TO THE USE OF ELECTRONIC SIGNATURES, CONTRACTS, ORDERS AND OTHER RECORDS AND TO ELECTRONIC DELIVERY OF NOTICES, POLICIES AND RECORDS OF TRANSACTIONS INITIATED OR COMPLETED THROUGH THE BITCOIN DEPOT OFFERINGS AND RATIFY THAT YOU ADMIT AS VALID, FOR THE PURPOSES OF PROVING AUTHORSHIP, AUTHENTICITY AND INTEGRITY, FOR ALL PURPOSES OF LAW, THE SIGNATURE BY ELECTRONIC MEANS, WHICH MAY OR MAY NOT INCLUDE CERTIFICATES ISSUED BY THE BRAZILIAN PUBLIC KEY INFRASTRUCTURE (ICP-BRASIL), AS PROVIDED FOR IN ARTICLE 10, PARAGRAPH 2, OF PROVISIONAL MEASURE NO. 2,200-2, OF AUGUST 24, 2001. Further, you hereby waive any rights and/or requirements under any statutes, regulations, rules, ordinances, or other law in any jurisdiction which requires an original signature or delivery or retention of non-electronic records, or to payments or the granting of credits by other than electronic means. You acknowledge and agree that you can print information delivered to you electronically, or otherwise know how to store that information in a way that ensures that it remains accessible to you in unchanged form.

 

9.3 Assinaturas Eletrônicas: A autorização da Bitcoin Depot para fornecer e faturar pelas Ofertas da Bitcoin Depot aplicáveis é obtida por meio da sua assinatura eletrônica ou, quando aplicável, por assinatura física e/ou afirmação por voz. Uma vez que uma assinatura eletrônica é enviada, essa ordem eletrônica constitui uma carta de mandato eletrônica. A confiança da Bitcoin Depot em sua assinatura eletrônica foi especificamente sancionada e registrada em lei quando a Lei Uniforme de Transações Eletrônicas e a Lei de Assinaturas Eletrônicas em Transações Globais e Nacionais foram promulgadas em 1999 e 2000, respectivamente, e pela Medida Provisória nº 2.200-2, de 24 de agosto de 2001 (coletivamente, a "Lei da Assinatura Eletrônica"). Ambas as leis (Lei Uniforme de Transações Eletrônicas e Lei de Assinaturas Eletrônicas em Transações Globais e Nacionais) prevalece especificamente todas as leis estaduais que reconhecem apenas assinaturas em papel e manuscritas. De acordo com todas as leis, regulamentos, regras, ordenanças ou outras leis aplicáveis, incluindo, sem limitação, a Lei E-Sign e outras leis estaduais e federais similares, VOCÊ CONCORDA COM O USO DE ASSINATURAS ELETRÔNICAS, CONTRATOS, ORDENS E OUTROS REGISTROS, BEM COMO A ENTREGA ELETRÔNICA DE AVISOS, POLÍTICAS E REGISTROS DE TRANSAÇÕES INICIADAS OU CONCLUÍDAS POR MEIO DAS OFERTAS DA BITCOIN DEPOT E RATIFICA QUE VOCÊ ADMITE COMO VÁLIDA,  PARA FINS DE PROVA DE AUTORIA, AUTENTICIDADE E INTEGRIDADE, PARA TODOS OS FINS DE LEI, A ASSINATURA POR MEIOS ELETRÔNICOS, QUE PODE OU NÃO INCLUIR CERTIFICADOS EMITIDOS PELA INFRAESTRUTURA DE CHAVE PÚBLICA BRASILEIRA (ICP-BRASIL), CONFORME PREVISTO NO ARTIGO 10, PÁRÁGRAFO 2, DA MEDIDA PROVISÓRIA Nº 2.200-2, DE 24 DE AGOSTO DE 2001. Além disso, você renuncia a quaisquer direitos e/ou requisitos sob quaisquer estatutos, regulamentos, regras, ordenanças ou outras leis em qualquer jurisdição que exija assinatura original, entrega ou retenção de registros não eletrônicos, ou pagamentos ou concessões de créditos por meios que não eletrônicos. Você reconhece e concorda que pode imprimir as informações entregues eletronicamente, ou sabe como armazená-las de forma que garanta que permaneçam acessíveis para você na mesma forma.

10.1. ​Bitcoin Depot has not offered or given and will not provide any investment or financial advice in connection with any Customer Purchase Transaction or any other action taken in connection with any Digital Currency and has not offered or given any opinion with respect to the suitability of any transaction made, or Digital Currency action taken, or which might be made/taken by the Customer. Nothing we do, and no element of the Bitcoin Depot Offerings, should be construed as such. The Customer warrants that Bitcoin Depot has not offered or given any investment advice to Customer in connection with the Digital Currency, Bitcoin Depot Offerings and/or any other products and/or services offered by Bitcoin Depot. In addition, Bitcoin Depot has not given Customer any opinion with respect to the suitability of the Digital Currency, Bitcoin Depot Offerings and/or any other products and/or services available to Customer.

 

10.1. 11. Rules of Behavior. At all times, you must abide by: (a) all applicable International, Federal, State and local laws; (b) all applicable money laundering laws and regulations; and (c) all applicable money licensing laws and regulations. In connection with your use of our Site, Kiosks, any other Bitcoin Depot Offerings, or in the course of your interactions with Bitcoin Depot, other Users, or third parties, you will not engage in any of the following Restricted Activities:

(a) User Content. In connection with the Interactive Services, Users may be able to upload and/or post certain comments, messages, material, communications, feedback and/or other information (collectively, the “User Content”). By making the User Content available by and through the Interactive Services or otherwise through the Bitcoin Depot Offerings, each User grants to Bitcoin Depot a perpetual, irrevocable, worldwide license to make same available by and through the Bitcoin Depot Offerings. Without limiting the foregoing, Users acknowledge and agree that Bitcoin Depot shall be free to utilize certain features and aspects of the User Content in connection with marketing and promoting the Bitcoin Depot Offerings to third parties. Each User represents and warrants that she/he/it owns and/or has any and all rights to publish, display, perform and permit the use of, and grant the license associated with, the User Content as contemplated by the Agreement. Without limiting the foregoing, Bitcoin Depot may reject and/or remove any User Content at any time and for any reason, in Bitcoin Depot’s sole discretion. Notwithstanding the foregoing, Bitcoin Depot undertakes no responsibility to monitor or otherwise police the User Content made available by and through the Bitcoin Depot Offerings. Each User and third-party agrees that Bitcoin Depot shall: (i) have no obligations and incur no liabilities to such party in connection with any such User Content; and (ii) not be liable to any party for any claim in connection with the User Content.

In connection with the User Content, each User agrees not to: (i) display any telephone numbers, street addresses, last names, URLs, e-mail addresses or any confidential or private information of any third-party; (ii) display any audio files, text, photographs, videos or other images that may be deemed indecent or obscene in the applicable User’s community, as defined under applicable law; (iii) impersonate any person or entity; (iv) “stalk” or otherwise harass any person; (v) engage in advertising to, or commercial solicitation of, Users or other third parties; (vi) transmit any chain letters, spam or junk e-mail to any Users or other third parties; (vii) express or imply that any statements she/he makes are endorsed by Bitcoin Depot ; (viii) harvest or collect personal information of Users or other third parties whether or not for commercial purposes, without their express consent; (ix) use any robot, spider, site search/retrieval application, or other manual or automatic device or process to retrieve, index, “data mine,” or in any way reproduce or circumvent the navigational structure or presentation of the Bitcoin Depot Offerings or related content; (x) post, distribute or reproduce in any way any copyrighted material, trademarks or other proprietary information without obtaining the prior consent of the owner of such proprietary rights; (xi) remove any copyright, trademark or other proprietary rights notices contained within the Bitcoin Depot Offerings; (xii) post, offer for download, e-mail or otherwise transmit any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment; (xiii) post, offer for download, transmit, promote or otherwise make available any software, product or service that is illegal or that violates the rights of a third-party including, but not limited to, spyware, adware, programs designed to send unsolicited advertisements (i.e. “spamware”), services that send unsolicited advertisements, programs designed to initiate “denial of service” attacks, mail bomb programs and programs designed to gain unauthorized access to networks on the Internet; (xiv) “frame” or “mirror” any part of the Site; (xv) use metatags or code or other devices containing any reference to the Bitcoin Depot Offerings in order to direct any person to any other website for any purpose; and/or (xvi) modify, adapt, sublicense, translate, sell, reverse engineer, decipher, decompile or otherwise disassemble any portion of the Bitcoin Depot Offerings or any software used on or in connection with same. Engaging in any of the aforementioned prohibited practices shall be deemed a breach of the Agreement and may result in the immediate termination of such User’s Account and/or access to some or all of the Bitcoin Depot Offerings without notice, in the sole discretion of Bitcoin Depot. Bitcoin Depot reserves the right to pursue any and all legal remedies against Users that engage in the aforementioned prohibited conduct.

Em conexão com o Conteúdo do Usuário, cada Usuário concorda em não (i) exibir números de telefone, endereços de rua, sobrenomes, URLs, endereços de e-mail ou qualquer informação confidencial ou privada de terceiros; (ii) exibir quaisquer arquivos de áudio, texto, fotografias, vídeos ou outras imagens que possam ser considerados indecentes ou obscenos na comunidade do Usuário aplicável, conforme definido pela lei aplicável; (iii) se passar por qualquer pessoa ou entidade; (iv) "perseguir" ou assediar qualquer pessoa de alguma forma; (v) realizar publicidade ou solicitação comercial de, Usuários ou outros terceiros; (vi) transmitir qualquer cadeia de cartas, spam ou e-mails de spam para quaisquer Usuários ou terceiros; (vii) expressar ou implicar que quaisquer declarações que ela/ele faça são endossadas pela Bitcoin Depot; (viii) colher ou coletar informações pessoais de Usuários ou outros terceiros, seja para fins comerciais ou não, sem seu consentimento expresso; (ix) utilizar qualquer robô, aranha, aplicativo de busca/recuperação de sites ou outro dispositivo ou processo manual ou automático para recuperar, indexar, "minerar dados" ou de qualquer forma reproduzir ou contornar a estrutura de navegação ou apresentação das Ofertas da Bitcoin Depot ou conteúdo relacionado; (x) postar, distribuir ou reproduzir de qualquer forma qualquer material protegido por direitos autorais, marcas registradas ou outras informações proprietárias sem obter o consentimento prévio do titular desses direitos proprietários; (xi) remover quaisquer avisos de direitos autorais, marcas registradas ou outros direitos proprietários contidos nas Ofertas da Bitcoin Depot; (xii) postar, oferecer para download, enviar e-mail ou transmitir qualquer material que contenha vírus de software ou qualquer outro código de computador, arquivos ou programas projetados para interromper, destruir ou limitar a funcionalidade de qualquer software, hardware ou equipamento de telecomunicações; (xiii) postar, oferecer para download, transmitir, promover ou de outra forma disponibilizar qualquer software, produto ou serviço que seja ilegal ou que viole os direitos de terceiros, incluindo, mas não se limitando a, spyware, adware, programas projetados para enviar anúncios não solicitados (ou seja, "spamware"), serviços que enviam anúncios não solicitados, programas projetados para iniciar ataques de "negação de serviço", programas de mail bomb e programas projetados para obter acesso não autorizado a redes na Internet;  (xiv) "enquadrar " (frame) ou "espelhar" (mirror) qualquer parte do Site; (xv) usar metatags, códigos ou outros dispositivos contendo qualquer referência às Ofertas da Bitcoin Depot para direcionar qualquer pessoa a qualquer outro site para qualquer propósito; e/ou (xvi) modificar, adaptar, sublicenciar, traduzir, vender, reverter engenharia, decifrar, descompilar ou de alguma forma desmontar qualquer parte das Ofertas da Bitcoin Depot ou qualquer software usado em ou em conexão com elas. Realizar qualquer uma das práticas proibidas mencionadas será considerado uma violação do Contrato e pode resultar na rescisão imediata da Conta do Usuário e/ou no acesso a algumas ou todas as Ofertas da Bitcoin Depot sem aviso prévio, a critério exclusivo da Bitcoin Depot. A Bitcoin Depot reserva-se o direito de buscar quaisquer e quaisquer recursos legais contra Usuários que se envolvam na conduta proibida mencionada anteriormente.

 

 

13. Social Media Pages. The Site contains links to the various Bitcoin Depot Social Media Pages. The Social Media Pages are hosted and made available on third-party Social Media Websites by third-party entities. Your use of Social Media Pages and Social Media Websites shall be governed by those Social Media Websites’ applicable agreements, terms and conditions. You understand and agree that Bitcoin Depot shall not be liable to you, any other User or any third-party for any claim in connection with your use of, or inability to use, the Social Media Pages and/or Social Media Websites.

The Bitcoin Depot Venues contain Content which includes, but is not limited to, User Content, text, audio, video, photographs, graphics, artwork, testimonials and other information about Bitcoin Depot and/or the Bitcoin Depot Offerings.      The Content is compiled, distributed and displayed by Bitcoin Depot, as well as third-party content providers, such as third-party sources and other Users (collectively, “Third-Party Providers”). The Content should not necessarily be relied upon. Reliance on any Content or other information made available to you by and through the Bitcoin Depot Offerings is solely at your own risk. Bitcoin Depot does not represent or warrant that the Content and other information posted by and through the Bitcoin Depot Offerings is accurate, complete, up-to-date or appropriate. You understand and agree that Bitcoin Depot will not be responsible for, and Bitcoin Depot undertakes no responsibility to monitor or otherwise police, Content provided by Third-Party Providers. 15. Our Liability - Actions We May Take and Our Limitation of Liability.

15.1. ​Compliance and Due Diligence. The Customer is responsible for complying with all laws of the jurisdiction from which the Customer accesses the Site, Kiosks or other Bitcoin Depot Offerings and the Customer shall at all times be solely responsible for obtaining any authorizations required by any authoritative body in such jurisdiction. The Customer has carried out reasonable due diligence to ensure that the purchase of Digital Currency as provided under the Agreement is not contrary to any laws or regulations applicable to the Customer’s governing jurisdiction, and that the acceptance of the Agreement by the Customer and the entering into a Customer Purchase Transaction is not contrary to any federal, provincial, state or any other law or regulation applicable to the Customer.

15.1. Conformidade e Diligência. O Cliente é responsável por cumprir todas as leis da jurisdição de onde acessa o Site, Quiosques ou outras Ofertas da Bitcoin Depot e o Cliente será o único responsável em todos os momentos por obter quaisquer autorizações exigidas por qualquer órgão autoritário nessa jurisdição. O Cliente realizou uma diligência razoável para garantir que a compra de Moeda Digital conforme previsto no Contrato não seja contrária a nenhuma lei ou regulamento aplicável à jurisdição vigente do Cliente, e que a aceitação do Contrato pelo Cliente e a celebração de uma Transação de Compra com o Cliente não sejam contrárias a qualquer lei federal, municipal, estadual ou qualquer outra lei ou regulamento aplicável ao Cliente.

 

 

15.2. ​Protection of Electronic Identification Information. It is the Customer's obligation to ensure that its Account username and password (“Electronic Identification Information”) is kept secret and secure. The Customer agrees to keep her/his/its Electronic Identification Information and all components thereof secret and safe to prevent unauthorized use.

É obrigação do Cliente garantir que o nome de Usuário e a senha da Conta ("Informações de Identificação Eletrônica") sejam mantidos em segredo e seguros. 15.3. Notification. If a Customer believes that any transaction or balance recorded in her/his/its Account is incorrect, the Customer must contact Bitcoin Depot immediately to notify Bitcoin Depot of suspected unauthorized use of Customer's Electronic Identification Information. Customers are responsible for ensuring the accuracy of the information displayed in their respective Accounts, howsoever accessed. Bitcoin Depot will not be liable should a Customer fail to disclose any unauthorized use of Electronic Identification Information and/or Customer's Bitcoin Depot Account.

15.3. Notificação. Se um Cliente acreditar que qualquer transação ou saldo registrado em sua Conta está incorreto, deve entrar em contato imediatamente com a Bitcoin Depot para notificar o uso suspeito e não autorizado das Informações de Identificação Eletrônica do Cliente. Os clientes são responsáveis por garantir a precisão das informações exibidas em suas respectivas Contas, seja qual for o acesso. A Bitcoin Depot não será responsabilizada caso um cliente não divulgue qualquer uso não autorizado das Informações de Identificação Eletrônica e/ou da Conta Bitcoin Depot do Cliente.

 

 

15.4. ​YOUR LIABILITY. YOU ARE RESPONSIBLE FOR ALL REVERSALS, CHARGEBACKS, CLAIMS, FEES, FINES, PENALTIES AND OTHER LIABILITY INCURRED BY BITCOIN DEPOT, A USER, OR A THIRD PARTY CAUSED BY OR ARISING OUT OF YOUR BREACH OF THE AGREEMENT, AND/OR YOUR USE OF THE BITCOIN DEPOT OFFERINGS. YOU AGREE TO REIMBURSE BITCOIN DEPOT, ITS USERS AND/OR THIRD PARTIES FOR ANY AND ALL SUCH LIABILITY.

 

15.4. SUA RESPONSABILIDADE. VOCÊ É RESPONSÁVEL POR TODAS AS REVERSÕES, ESTORNOS, REIVINDICAÇÕES, TAXAS, MULTAS, PENALIDADES E OUTRAS RESPONSABILIDADES INCORRIDAS PELA BITCOIN DEPOT, UM USUÁRIO OU UM TERCEIRO, CAUSADAS POR OU DECORRENTES DA SUA VIOLAÇÃO DO ACORDO E/OU DO USO DAS OFERTAS DA BITCOIN DEPOT. VOCÊ CONCORDA EM REEMBOLSAR A BITCOIN DEPOT, SEUS USUÁRIOS E/OU TERCEIROS POR QUALQUER E TODA ESSA RESPONSABILIDADE.

 

 

15.5. ​Temporary Holds for Disputed Transactions. If another User files a dispute on a transaction that you were party to, Bitcoin Depot may place a temporary hold on the funds in your Account to cover the amount of the potential liability. If you win the dispute, Bitcoin Depot will lift the temporary hold. If you lose the dispute, Bitcoin Depot will remove the funds from your balance.

15.5. Retenções Temporárias para Transações Contestadas. Se outro Usuário abrir uma disputa em uma transação da qual você participou, a Bitcoin Depot pode impor uma retenção temporária nos fundos da sua Conta para cobrir o valor da responsabilidade potencial. Se você vencer a disputa, a Bitcoin Depot levantará a retenção temporária. Se você perder a disputa, a Bitcoin Depot removerá os fundos do seu saldo.

 

 

15.6. ​Reimbursement for Your Liability. In the event that you are liable for any amounts to Bitcoin Depot or owe any sums to Bitcoin Depot, and Bitcoin Depot offers the holding of a balance, Bitcoin Depot may immediately remove such amounts from your balance. If you do not have a balance that is sufficient to cover your liability, your Account will have a negative balance and you will be required to immediately add funds to your balance to eliminate the negative balance. If you do not do so, Bitcoin Depot may engage in collection efforts to recover such amounts from you and you will be liable for all such costs of collection, including attorneys’ fees.

 

15.6. Reembolso pela sua responsabilidade. Caso você seja responsável por qualquer valor à Bitcoin Depot ou deva qualquer valor à Bitcoin Depot, e a Bitcoin Depot oferece a possibilidade de manutenção de saldo em conta, a Bitcoin Depot pode remover imediatamente esses valores do seu saldo. If we have reason to believe that you have engaged in any Restricted Activities, we may take various actions to protect Bitcoin Depot, other Users, third parties, or you from reversals, chargebacks, claims, fees, fines, penalties and any other liability. The actions we may take include, but are not limited to, the following:

15.7.1. ​​WE MAY CLOSE, SUSPEND, OR LIMIT YOUR ACCESS TO YOUR ACCOUNT OR THE BITCOIN DEPOT OFFERINGS (SUCH AS LIMITING ACCESS TO ANY OF YOUR PAYMENT METHODS, AND/OR YOUR ABILITY TO SEND MONEY, MAKE WITHDRAWALS OR REMOVE FINANCIAL INFORMATION).

15.7.2. ​​We may contact Users who have purchased goods or services from you, contact your bank or Payment Card issuer and/or warn other Users, law enforcement or impacted third parties of your actions.

If we close your Account or terminate your use of the Bitcoin Depot Offerings for any reason, we may provide you with a general notice of our actions, however we don’t have to provide the specific reason. If we limit access to your Account, we may provide you with notice of our actions and the opportunity to request restoration of access if appropriate.

 

15.8. Fechamento da Conta, Encerramento do Serviço ou Acesso Limitado à Conta. A Bitcoin Depot, a seu exclusivo critério, reserva-se o direito de rescindir o Contrato, o acesso aos Locais da Bitcoin Depot e/ou o acesso às outras Ofertas da Bitcoin Depot por qualquer motivo e a qualquer momento, mediante notificação a você. Se encerrarmos sua Conta ou encerrarmos seu uso das Ofertas da Bitcoin Depot por qualquer motivo, podemos fornecer um aviso geral de nossas ações, porém não precisamos fornecer o motivo específico. 15.9. ​Acceptable Use Policy Violation. If you violate the Acceptable Use Policy, then we may hold your funds up to one hundred and eighty (180) Days (or such longer period if permitted by applicable law) pending investigation of the violation.

You agree to defend, indemnify, and hold harmless each Bitcoin Depot Party from any claim, demand, action, damage, loss, cost or expense including, without limitation, attorneys’ fees, arising out or relating to: (a) your unauthorized use of, or improper conduct in connection with, the Bitcoin Depot Offerings; (b) your violation of the Agreement; or (c) your violation of any rights of any other person or entity. If you are obligated to indemnify us, we will have the right, in our sole discretion, to control any action or proceeding and determine whether we wish to settle it, and if so, on what terms. The provisions of this Section 15.11 are for the benefit of the Bitcoin Depot parties and each of these individuals and entities shall have the right to assert and enforce these provisions directly against you on its own behalf.

15.11. Indenização. Você concorda em defender, indenizar e isentar cada Parte da Bitcoin Depot de qualquer reivindicação, demanda, ação, dano, perda, custo ou despesa, incluindo, sem limitação, honorários advocatícios, decorrentes ou relacionados a: (a) seu uso não autorizado ou conduta imprópria em conexão com as Ofertas da Bitcoin Depot; (b) sua violação do Contrato; ou (c) sua violação de quaisquer direitos de qualquer outra pessoa ou entidade. Se você for obrigado a nos indenizar, teremos o direito, a nosso exclusivo critério, de controlar qualquer ação ou processo e decidir se desejamos resolvê-lo e, em caso afirmativo, em quais termos. As disposições desta Seção 15.11 são para benefício das Partes da Bitcoin Depot e cada um desses indivíduos e entidades terá o direito de reivindicar e aplicar essas disposições diretamente contra você em seu próprio nome.

 

 

16. Copyright Policy/DMCA Compliance. Bitcoin Depot reserves the right to terminate the Account of any User upon prior notice  who infringes upon third-party copyrights. If any User or other third-party believes that a copyrighted work has been copied and/or posted via the Bitcoin Depot Offerings in a way that constitutes copyright infringement, that party should provide Bitcoin Depot with the following information: (a) an electronic or physical signature of the person authorized to act on behalf of the owner of the copyrighted work; (b) an identification and location of the copyrighted work that such party claims has been infringed upon; (c) a written statement by such party that it has a good faith belief that the disputed use is not authorized by the owner, its agent or the law; (d) such party’s name and contact information, such as telephone number or e-mail address; and (e) a statement by such party that the above information in such party’s notice is accurate and, under penalty of perjury, that such party is the copyright owner or authorized to act on the copyright owner’s behalf. Se algum Usuário ou outro terceiro acreditar que uma obra protegida por direitos autorais foi copiada e/ou publicada via as Ofertas da Bitcoin Depot de forma que constitua violação de direitos autorais, essa parte deve fornecer à Bitcoin Depot as seguintes informações: (a) uma assinatura eletrônica ou física da pessoa autorizada a agir em nome do proprietário da obra protegida por direitos autorais; (b) a identificação e localização da obra protegida por direitos autorais sobre a qual tal parte alega ter sido infringida; (c) uma declaração escrita dessa parte de que acredita de boa-fé que o uso contestado não é autorizado pelo proprietário, seu agente ou pela lei; (d) o nome e as informações de contato dessa parte, como número de telefone ou endereço de e-mail; e (e) uma declaração dessa parte de que as informações acima no aviso dessa parte são precisas e, sob pena de falsidade, que tal parte é o detentor dos direitos autorais ou está autorizado a agir em nome do titular dos direitos autorais. 17. Disputes with Bitcoin Depot.

17.1. ​Dispute Resolution Provisions. The Agreement shall be treated as though it were executed and performed in Brazil, and shall be governed by and construed in accordance with the laws of Brazil, except in the cases in which a certain jurisdiction law provides differently. All claims that may arise under the Agreement shall be submitted to a Brazilian State Court, which will prevail over any other, no matter how privileged it may be.

17.1. Disposições de Resolução de Disputas. O Contrato será tratado como se tivesse sido celebrado e executado no Brasil, e será regido e interpretado de acordo com as leis brasileiras, exceto nos casos em que determinada lei jurisdicional dispõe de forma diferente. Todas as reivindicações que possam surgir sob o Contrato serão submetidas a um Tribunal Estadual brasileiro, que prevalecerá sobre qualquer outro, por mais privilegiado que seja.

 

 

17.2. ​No Waiver. Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches.

17.3. ​Assumption of Rights. If Bitcoin Depot pays out a Claim, reversal or Chargeback that you file against a recipient of your payment, you agree that Bitcoin Depot assumes your rights against the recipient and third parties related to such payment, and we may pursue those rights directly or on your behalf, in Bitcoin Depot’s discretion.

 

17.3. Assunção de Direitos. 17.5. Limitation on Actions. To the extent allowed by law, you agree and understand that any legal action against any Covered Parties must be instituted in accordance with the applicable laws.

18. General Provisions.

18.1. ​Capital Gains/Income Taxes. Bitcoin Depot may report Customer transactions to the Brazilian Federal Revenue Service, as required by the applicable law. Additionally, the Customer must be compliant and observe all of his/hers tax obligation while operating with Bitcoin Depot or via a Bitcoin Depot Offering. Bitcoin Depot will not be held liable for any capital gains or tax implications due to the purchase of Digital Currency by the Customer. Your taxes are solely your responsibility.

18.1. Ganhos de capital/impostos de renda. A Bitcoin Depot pode reportar transações de clientes à Receita Federal, conforme exigido pela regulação aplicável. Adicionalmente, o Cliente deverá cumprir com todas as suas obrigações tributárias quando operar através da Bitcoin Depot ou da Ofertas da Bitcoin Depot. e tributária. A Bitcoin Depot  não será responsabilizada por ganhos de capital ou implicações fiscais decorrentes da compra de Moeda Digital pelo Cliente. Seus impostos são exclusivamente sua responsabilidade.

 

 

18.2. ​Electronic Order Entry Risk Disclosure and Disclaimer.

18.2.1. ​​Bitcoin Depot specifically disclaims any liability or responsibility for Orders placed via any Bitcoin Depot Order entry system, for any losses or direct, indirect, consequential or incidental damages, which the Customer may recognize or incur as a result of the use of any Order entry system. Further, Bitcoin Depot specifically disclaims any and all liability for the interruption, cancellation or other termination of any Bitcoin Depot Order entry system or any other Bitcoin Depot Offerings.

 

18.2.1. A Bitcoin Depot especificamente renuncia a qualquer responsabilidade ou responsabilidade por Ordens realizadas por meio de qualquer sistema de entrada de Ordens da Bitcoin Depot, por quaisquer perdas ou danos diretos, indiretos, consequentes ou incidentais, que o Cliente possa reconhecer ou incorrer como resultado do uso de qualquer sistema de registro de Ordens. Além disso, a Bitcoin Depot expressamente isenta qualquer responsabilidade pela interrupção, cancelamento ou outra rescisão de qualquer sistema de entrada de Ordens Bitcoin Depot ou de quaisquer outras Ofertas da Bitcoin Depot.

 

 

18.2.2. ​​Negligence. All Orders placed through any Bitcoin Depot Order entry system are taken on a best-efforts basis. Bitcoin Depot shall not be responsible for errors, negligence or inability to execute Orders, nor shall Bitcoin Depot be responsible for any delays in the transmission, delivery or execution of Customer's Order(s) due to breakdown or failure of transmission or communication facilities, or for any other cause or causes beyond Bitcoin Depot’s reasonable control or anticipation.

18.2.2. Negligência. Todas as Ordens feitas por meio de qualquer sistema de entrada de ordens Bitcoin Depot são recebidas com base em melhores esforços. A Bitcoin Depot não será responsável por erros, negligência ou incapacidade de executar Ordens, nem será responsável por atrasos na transmissão, entrega ou execução da(s) Ordem(ns) do Cliente devido a falha ou falha nas instalações de transmissão ou comunicação, ou por qualquer outra causa ou causas além do controle ou antecipação razoável da Bitcoin Depot.

 

 

18.3. ​Possible System Failure. Order entry systems have been designed to provide an efficient and dependable method for entering Orders. Commercial Internet and wireless service providers are not one hundred percent (100%) reliable and a failure by one (1) or more of these providers may affect Order entry. The Customer acknowledges that the Order entry systems are mechanical systems and as such may be subject to failure beyond the control of Bitcoin Depot. ​

18.3. Possível falha do sistema. Os sistemas de registro de Ordens foram projetados para fornecer um método eficiente e confiável para registrar Ordens. Provedores comerciais de Internet e serviços sem fio não são cem por cento (100%) confiáveis, e uma falha de um (1) ou mais desses provedores pode afetar a entrada de pedidos. O Cliente reconhece que os sistemas de entrada de Ordens são mecânicos e, portanto, podem estar sujeitos a falhas além do controle da Bitcoin Depot. ​

 

 

​18.4. ​Force Majeure. Bitcoin Depot shall not be liable for any failure to perform its obligations hereunder due to the effects of Covid 19 or any similar virus, disease or pandemic (and any governmental and private sector responses thereto), fire, computer viruses, network failure, computer hardware failure, explosion, flood, lightning, act of terrorism, war, rebellion, riot, sabotage, orders or requests of any government or any other authority, legislative changes, strikes, lockouts or other labor disputes, or events or circumstances beyond its reasonable control.

 

18.4. Força Maior. A Bitcoin Depot não será responsabilizada por qualquer falha em cumprir suas obrigações aqui presentes devido aos efeitos da Covid-19 ou de qualquer vírus, doença ou pandemia semelhante (e quaisquer respostas governamentais e do setor privado a isso), incêndio, vírus de computador, falha de rede, falha de hardware do computador, explosão, enchente, raio, ato de terrorismo, guerra, rebelião, motim, sabotagem, ordens ou pedidos de qualquer governo ou qualquer outra autoridade,  mudanças legislativas, greves ou outros conflitos trabalhistas, ou eventos ou circunstâncias além de seu controle razoável.

 

 

18.5. ​Not Legal, Accounting, Nor Tax Advice. Information and Content made available by and through the Bitcoin Depot Offerings is not intended to provide legal, accounting or tax advice, and should not be relied upon in that regard.

AS OFERTAS DA BITCOIN DEPOT E QUAISQUER OUTROS PRODUTOS E/OU SERVIÇOS OFERECIDOS POR E/OU ATRAVÉS DELES SÃO FORNECIDOS AOS USUÁRIOS EM BASE "COMO ESTÃO" E "CONFORME DISPONÍVEL" E TODAS AS GARANTIAS, EXPRESSAS E IMPLÍCITAS, SÃO RENUNCIADAS NA MÁXIMA EXTENSÃO PERMITIDA CONFORME A LEI APLICÁVEL (INCLUINDO, MAS NÃO SE LIMITANDO A, A RENÚNCIA DE QUAISQUER GARANTIAS DE COMERCIALIZAÇÃO,  NÃO VIOLAÇÃO DE PROPRIEDADE INTELECTUAL E/OU ADEQUAÇÃO PARA UM PROPÓSITO ESPECÍFICO). EM PARTICULAR, MAS NÃO COMO LIMITAÇÃO, A BITCOIN DEPOT NÃO GARANTE QUE AS OFERTAS DA BITCOIN DEPOT E/OU QUAISQUER OUTROS PRODUTOS E/OU SERVIÇOS OFERECIDOS POR E/OU ATRAVÉS DELES: (A) ATENDAM AOS REQUISITOS DE QUALQUER USUÁRIO; (B) SERÁ ININTERRUPTA, OPORTUNA, SEGURA OU SEM ERROS, OU QUE DEFEITOS SERÃO CORRIGIDOS; (C) ESTARÁ LIVRE DE COMPONENTES NOCIVOS; (D) PERMITIRÁ QUE QUALQUER USUÁRIO REALIZE QUALQUER OBJETIVO FINANCEIRO ESPECÍFICO, BENEFÍCIO FINANCEIRO, RESULTADO DE INVESTIMENTO E/OU OUTRO RESULTADO FINANCEIRO; E/OU (E) SERÁ PRECISO OU CONFIÁVEL. AS OFERTAS DA BITCOIN DEPOT E/OU QUAISQUER OUTROS PRODUTOS E/OU SERVIÇOS OFERECIDOS     POR E/OU ATRAVÉS DO MESMO PODE CONTER BUGS, ERROS, PROBLEMAS OU OUTRAS LIMITAÇÕES. A BITCOIN DEPOT NÃO SERÁ RESPONSÁVEL PELA DISPONIBILIDADE DA CONEXÃO DE INTERNET SUBJACENTE ASSOCIADA ÀS OFERTAS DA BITCOIN DEPOT. NENHUM CONSELHO OU INFORMAÇÃO, SEJA ORAL OU ESCRITA, OBTIDA POR QUALQUER USUÁRIO DA BITCOIN DEPOT OU DE OUTRA FORMA OU ATRAVÉS DAS OFERTAS DA BITCOIN DEPOT CRIARÁ QUALQUER GARANTIA QUE NÃO ESTEJA EXPRESSAMENTE DECLARADA NO CONTRATO. A BITCOIN DEPOT TEM POUCO CONTROLE SOBRE OS PRODUTOS OU SERVIÇOS PAGOS POR E POR MEIO DAS OFERTAS DA BITCOIN DEPOT, E A BITCOIN DEPOT NÃO PODE GARANTIR QUE UM COMPRADOR OU VENDEDOR COM QUEM VOCÊ ESTÁ LIDANDO EM RELAÇÃO A ISSO REALMENTE CONCLUA A TRANSAÇÃO OU ESTEJA AUTORIZADO A FAZÊ-LO. A BITCOIN DEPOT FARÁ ESFORÇOS RAZOÁVEIS PARA GARANTIR QUE SOLICITAÇÕES DE DÉBITOS ELETRÔNICOS E CRÉDITOS ENVOLVENDO CONTAS BANCÁRIAS, CARTÕES DE CRÉDITO, EMISSÃO DE CHEQUES E MOEDA DIGITAL SEJAM PROCESSADAS EM TEMPO HÁBIL, MAS A BITCOIN DEPOT NÃO FAZ NENHUMA DECLARAÇÃO OU GARANTIA SOBRE O TEMPO NECESSÁRIO PARA CONCLUIR O PROCESSAMENTO, POIS AS OFERTAS DE BITCOIN™ DEPENDEM DE MUITOS FATORES FORA DO NOSSO CONTROLE,  COMO ATRASOS NO SISTEMA BANCÁRIO, CONGESTIONAMENTO EM BLOCKCHAIN, OU NO SERVIÇO POSTAL. ALGUMAS JURISDIÇÕES NÃO PERMITEM A RENÚNCIA ÀS GARANTIAS IMPLÍCITAS, ENTÃO AS RENÚNCIAS ACIMA PODEM NÃO SE APLICAR A VOCÊ. ESTA SEÇÃO 18.6 LHE CONCEDE DIREITOS LEGAIS ESPECÍFICOS E VOCÊ TAMBÉM PODE TER OUTROS DIREITOS LEGAIS QUE VARIAM DE JURISDIÇÃO PARA JURISDIÇÃO.

 

 

18.7. ​License Grant; Proprietary Rights. Each User is granted a non-exclusive, non-transferable, revocable and limited license to access and use the Bitcoin Depot Offerings. Bitcoin Depot may terminate this license at any time for any reason. Unless otherwise expressly authorized by Bitcoin Depot, Users may only use the Bitcoin Depot Offerings for their own personal, non-commercial use. No part of the Bitcoin Depot Offerings may be reproduced in any form or incorporated into any information retrieval system, electronic or mechanical. No User or other third party may use any automated means or form of scraping or data extraction to access, query or otherwise collect material from the Bitcoin Depot Offerings except as expressly permitted by Bitcoin Depot. No User or other third party may use, copy, emulate, clone, rent, lease, sell, modify, decompile, disassemble, reverse engineer or transfer the Bitcoin Depot Offerings, or any portion thereof. No User or other third party may create any “derivative works” by altering any aspect of the Bitcoin Depot Offerings. No User or other third party may use the Bitcoin Depot Offerings in conjunction with any other third-party content. No User or other third party may exploit any aspect of the Bitcoin Depot Offerings for any commercial purposes not expressly permitted by Bitcoin Depot. Each User further agrees to indemnify and hold Bitcoin Depot harmless for that User’s failure to comply with this Section 18.7. Bitcoin Depot reserves any rights not explicitly granted in the Agreement. The Bitcoin Depot Offerings, as well as the organization, graphics, design, compilation, magnetic translation, digital conversion, software, services and other matters related to same, are protected under applicable copyrights, trademarks and other proprietary (including, but not limited to, intellectual property) rights. The copying, redistribution or publication by any User or other third party of any part of the Bitcoin Depot Offerings is strictly prohibited. No User or other third party acquires ownership rights in or to any content, document, software, services or other materials viewed by or through the Bitcoin Depot Offerings. The posting of information or material by and through the Bitcoin Depot Offerings does not constitute a waiver of any right in or to such information and/or materials.

 

 

 

 

 

18.7. Concessão de Licença; Direitos de Proprietário. Cada Usuário recebe uma licença não exclusiva, não transferível, revogável e limitada para acessar e usar as Ofertas da Bitcoin Depot. A Bitcoin Depot pode encerrar essa licença a qualquer momento e por qualquer motivo. Salvo autorização expressa da Bitcoin Depot, os Usuários só podem usar as Ofertas da Bitcoin Depot para uso pessoal e não comercial. Nenhuma parte das Ofertas da Bitcoin Depot pode ser reproduzida de qualquer forma ou incorporada a qualquer sistema de recuperação de informações, eletrônico ou mecânico. Nenhum Usuário ou outro terceiro pode usar qualquer meio automatizado ou forma de extração de dados para acessar, consultar ou coletar material das Ofertas da Bitcoin Depot, exceto quando expressamente permitido pela Bitcoin Depot. Nenhum Usuário ou outro terceiro pode usar, copiar, emular, clonar, alugar, arrendar, vender, modificar, descompilar, desmontar, fazer engenharia reversa ou transferir as Ofertas da Bitcoin Depot, ou qualquer parte delas. Nenhum Usuário ou outro terceiro pode criar quaisquer "obras derivadas" alterando qualquer aspecto das Ofertas da Bitcoin Depot. Nenhum Usuário ou outro terceiro pode usar as Ofertas da Bitcoin Depot em conjunto com qualquer outro conteúdo de terceiros. Nenhum Usuário ou outro terceiro pode explorar qualquer aspecto das Ofertas da Bitcoin Depot para fins comerciais não expressamente permitidos pela Bitcoin Depot. Cada Usuário concorda ainda em indenizar e isentar a Bitcoin Depot de responsabilidade pelo não cumprimento desta Seção 18.7. A Bitcoin Depot reserva quaisquer direitos que não estejam explicitamente concedidos no Contrato. As Ofertas da Bitcoin Depot, assim como a organização, gráficos, design, compilação, tradução magnética, conversão digital, software, serviços e outros assuntos relacionados, estão protegidos por direitos autorais aplicáveis, marcas registradas e outros direitos proprietários (incluindo, mas não se limitando a, propriedade intelectual). A cópia, redistribuição ou publicação por qualquer Usuário ou outro terceiro de qualquer parte das Ofertas da Bitcoin Depot é estritamente proibida. Nenhum Usuário ou outro terceiro adquire direitos de propriedade sobre ou sobre qualquer conteúdo, documento, software, serviço ou outro material visualizado por ou através das Ofertas da Bitcoin Depot. A publicação de informações ou materiais por e por meio das Ofertas da Bitcoin Depot não constitui uma renúncia a qualquer direito sobre ou sobre tais informações e/ou materiais.

 

 

18.8. ​Severability. If any provision of the Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced.

18.10 Third Party Websites. The Bitcoin Depot Offerings contain links to other websites on the Internet that are owned and operated by third parties including, without limitation, the Social Media Websites and/or Third-Party Links. Bitcoin Depot does not control the information, products or services made available on, by or through these third-party websites. The inclusion of any link does not imply endorsement by Bitcoin Depot of the applicable website or any association with the website’s operators. Because Bitcoin Depot has no control over such websites and/or resources, each User agrees that Bitcoin Depot is not responsible or liable for the availability or the operation of such external websites, for any material located on or available from or through any such websites or for the protection of any User’s data privacy by third parties. Each User further agrees that Bitcoin Depot shall not be responsible or liable, directly or indirectly, for any loss or damage caused by the use of or reliance on any such material available on, by or through any such site.

 

18.10 Sites de Terceiros. As Ofertas da Bitcoin Depot contêm links para outros sites na Internet que são propriedade e operados por terceiros, incluindo, sem limitação, os Sites de Redes Sociais e/ou Links de Terceiros. A Bitcoin Depot não controla as informações, produtos ou serviços disponibilizados em, por ou por meio desses sites de terceiros. A inclusão de qualquer link não implica endosso pela Bitcoin Depot do site aplicável ou qualquer associação com os operadores do site. Como a Bitcoin Depot não tem controle sobre esses sites e/ou recursos, cada Usuário concorda que a Bitcoin Depot não é responsável nem se responsabiliza  pela disponibilidade ou operação desses sites externos, por qualquer material localizado ou disponível em ou através de tais sites, ou pela proteção da privacidade dos dados de qualquer Usuário por terceiros. Cada Usuário concorda ainda que a Bitcoin Depot não será responsável ou não se responsabilizará, direta ou indiretamente, por qualquer perda ou dano causado pelo uso ou confiança em qualquer material disponível em, por ou através de qualquer desses sites.

 

 

     19. Definitions.

• "Account" means a Personal Account or Business Account.

• "ACH" means the Automated Clearing House network.

• "Business Account" means an Account used primarily for business purposes and not for personal, family, or household purposes.

• "Conta Empresarial" significa uma Conta usada principalmente para fins comerciais e não para fins pessoais, familiares ou domésticos.

 

 

• "Business Days" means Monday through Friday, excluding Holidays.

• "Dias Úteis" significa de segunda a sexta-feira, excluindo Feriados.

 

 

• "Chargeback" means a request that a buyer files directly with her/his/its credit card company or credit card issuing bank to invalidate a payment.

• "Claim" means a challenge to a payment that a User files directly with Bitcoin Depot.

• "Customer Purchase Transaction" shall mean any sale operation whereby Bitcoin Depot sells Digital Currency to its Customer.

• "Customer Service" is Bitcoin Depot’s customer support operations which can be accessed online through the Bitcoin Depot customer portal at any time, or by emailing support@BitcoinDepot.com or calling 678-435-9604.

• "Informação" significa qualquer informação confidencial e/ou pessoalmente identificável ou outra informação relacionada a uma Conta ou Usuário, incluindo, mas não se limitando a, o seguinte: nome, endereço de e-mail, endereço de faturamento/envio, número de telefone e informações financeiras.

 

 

• "Payment Method" means the payment method used to fund a transaction.

• "Método de Pagamento" significa o método de pagamento utilizado para financiar uma transação.

 

 

• "Personal Account" means an Account used for non-business purposes and used primarily for personal, family, or household purposes.

• "Conta Pessoal" significa uma Conta usada para fins não comerciais e usada principalmente para fins pessoais, familiares ou domésticos.

 

 

• "Policy" or "Policies" means any Policy or other agreement between you and Bitcoin Depot associated with your use of the Bitcoin Depot Offerings.

• "Política" ou "Políticas" significa qualquer Política ou outro acordo entre você e a Bitcoin Depot associado ao seu uso das Ofertas da Bitcoin Depot.

 

 

• "Restricted Activities" means those activities described in Section 11 of the Agreement.

"Atividades Restritas" significa aquelas atividades descritas na Seção 11 do Contrato.
